Terms of use

Preamble

So'bloo is a SaaS software platform developed by SKAZY that dematerializes and decentralizes numerous tasks related to sales management. Available 24/7, it offers maintenance and automatic updates.

These terms are dated 26 June 2024 and bind SKAZY (headquartered in Nouméa, New Caledonia) with the professional clients using So'bloo.

Article 1 – Definitions

Terms of Use: conditions governing use
Contract: contractual elements between Client and Company
Personal data: information relating to an identifiable person
Platform: the IT environment for the Services
Services: services provided under the Contract
User: an employee of the Client accessing the Platform

Article 3 – Site content / Intellectual property

All such elements remain the exclusive property of SKAZY or its partners. Any reproduction without written consent is strictly prohibited. SKAZY reserves the right to modify the information without notice.

Article 4 – Site management

SKAZY may:

Suspend or limit access, in whole or in part
Restrict access to certain users
Delete data that violates the law
Interrupt access for updates

Article 5 – Personal data

Information collected: name, surname, email, job title, logs, IP address of users.

Purposes: provision of services, technical management, customer support, IT security.

Legal basis:

Contractual necessity (performance of the Terms of Use)
Legitimate interests (IT security)

Retention:

Identification data: until the end of the contract, then archived per legal retention periods
Log files: 6 months

Cookies: authentication and technical cookies (XSFR-TOKEN, HTTP Only) used to identify the user.

User rights:

Access their data
Request rectification, erasure, or restriction
Obtain portability
Object to commercial/statistical processing
Give instructions on the fate of their data after death
Lodge a complaint with the CNIL

Article 6 – Usage rights

Absolute restrictions: users may not:

Copy the Platform
Act dishonestly or unprofessionally
Enter inaccurate data into fields
Use a fake profile photo
Create a fake identity or use a pseudonym
Use another person's account
Harass or harm others
Send spam or unsolicited communications
Copy profiles via web scraping
Act unlawfully, defamatorily or obscenely
Disclose other people's personal data
Infringe intellectual property rights
Post unauthorized advertisements
Collect data without consent
Share other people's information without their agreement
Monitor the Services for competitive purposes
Use "framing" or simulate the site's appearance
Access the Services other than through official interfaces
Circumvent security measures
Disrupt the operation of the Services
Analyze how the Services work (reverse engineering)
Decompile, disassemble or reverse-engineer the Platform
Modify or translate the Platform
Provide the Services to third parties
Transfer, lease or assign rights
Use robots (tools emulating human actions)

The Client shall indemnify SKAZY for all damages related to the use of robots.

Article 7 – Liability

SKAZY is not liable for failures, breakdowns or interruptions of service. The user is responsible for their own equipment and for protecting it against viruses. SKAZY disclaims all liability for damages resulting from connecting to or using the Platform.

Article 8 – Governing law

These Platform Terms of Use are governed by French law and subject to the jurisdiction of the competent courts of Nouméa.
